Introduction of penalties for Italian nationals who do not register in AIRE

Registration with the A.I.R.E. is a citizen’s right-duty (Art. 6, L. 470/1988) and is a prerequisite for availing of consular services provided by the Italian missions abroad, as well as for exercising important rights, such as voting by correspondence in political elections and referendums.

The following are required to register with AIRE: citizens who transfer their residence abroad for periods of more than 12 months; those who already reside there, either because they were born abroad or due to subsequent acquisition of Italian citizenship for any reason.

Law No. 213 of Dec. 30, 2023, effective Jan. 1, 2024, introduces a fine for Italian citizens residing abroad who are not registered with AIRE, providing for an administrative payment ranging from 200 to 1,000 euros for each year of non-registration, up to a maximum of five years.

Administrative penalties cannot be retroactive. Therefore, one cannot be sanctioned for the period prior to January 1, 2024.

Municipalities remain the sole authority responsible to establish a violation regarding registration and the imposition of the relevant penalty.
