We inform Italian citizens who are parents of minor children that, from the 14th of June 2023, it is no longer necessary to present the consent of the other parent for the purpose of obtaining their identity document (passport and/or identity card), as per Italian Law 69/2023.
Article 3-bis of Law 1185/1967 indicates that, when there is a concrete and actual danger of parental obligations being evaded due to the transfer of the minor abroad, it would be possible for the other parent to request a restriction to the release of the document.
The application can be presented to the competent judge of the ordinary Court where the minor has his/her residence or, if the minor is resident abroad, at the Court in whose district the Municipality of AIRE registration is located.
For the purposes of issuing documents for minors, on the other hand, the obligation of having consent signed by both parents (or the legal parental guardian) still remains.
